World leaders react to shooting at Trump rally: ‘Shocked’ at assassination attempt

0

World leaders have shared their shock and concern after gunshots rang out during a Trump rally in Pennsylvania Saturday.

“Sara and I were shocked by the apparent attack on President Trump,” Israeli Prime Minister Benjamin Netanyahu wrote on social media platform X. “We pray for his safety and speedy recovery.” In a video statement released on Sunday, Netanyahu said “This wasn’t just an attack on Donald Trump. This was an attack on a candidate for the presidency of the United States. This was an attack on America. It was an attack on democracy, it was an attack on all the democracies.”

Former President Trump was rushed off the stage by the Secret Service at a rally in Butler, Pennsylvania, after gunshots rang out. A law enforcement source told Fox News’ Jacqui Henrich the shooter is dead, and two people wounded were transported to a Pittsburgh hospital.

An FBI team is en route to the site to conduct an “assassination investigation,” a Secret Service source confirmed to Fox News’ Lucas Tomlinson.

“Political violence in any form has no place in our societies and my thoughts are with all the victims of this attack,” Starmer added.

Australian Prime Minister Anthony Albanese wrote “the incident at former President Trump’s campaign event in Pennsylvania today is concerning and confronting.”

BRET BAIER: THAT PICTURE OF TRUMP IS NOW AN ‘INDELIBLE IMAGE’

“There is no place for violence in the democratic process,” Albanese added. “I am relieved to hear reports that former President Trump is now safe.”

Hungarian Prime Minister Viktor Orban, a close ally of Trump who visited with the former president on Thursday, wrote, “My thoughts and prayers are with President [Donald Trump] in these dark hours.”

Another close Trump ally and leader of the Reform UK party, MP Nigel Farage, wrote on X, “Mainstream media have spread a narrative of hatred against my friend Donald Trump. I hope they are proud of themselves. Disgusting people.”

FAITH LEADERS SHARE URGENT PRAYERS FOR FORMER PRESIDENT DONALD TRUMP AFTER PENNSYLVANIA RALLY SHOOTING

“I am following with apprehension the updates from Pennsylvania, where the 45th President of the United States [Donald Trump] was shot during a rally,” Italian Prime Minister Giorgia Meloni wrote, according to a translation.

“My solidarity and my best wishes for a speedy recovery go to him, with the hope that the next few months of the electoral campaign will see dialogue and responsibility prevail over hatred and violence.”

Canadian Prime Minister Justin Trudeau wrote that he was “sickened” by the shooting, stressing that “It cannot be overstated — political violence is never acceptable.”

“My thoughts are with former President Trump, those at the event, and all Americans,” Trudeau wrote.

BIDEN CAMPAIGN PULLING ADS IN WAKE OF TRUMP RALLY SHOOTING

Brazilian President Luiz Inácio Lula da Silva wrote, “The attack against former President Donald Trump must be vehemently repudiated by all defenders of democracy and dialogue in politics. What we saw today is unacceptable,” according to a translation.

Argentinian President Javier Milei wrote that all of his “support and solidarity” were with Trump, calling him the “victim of a COWARDLY assassination attempt that put his life and that of hundreds of people at risk.”

“The desperation of the international left is not surprising, as today it sees its harmful ideology expire, and is willing to destabilize democracies and promote violence to screw itself into power,” Milei wrote, according to a translation. “In fear of losing at the polls, they resort to terrorism to impose their retrograde and authoritarian agenda.”

“I hope for a speedy recovery of President Trump and that the elections in the United States are held fairly, peacefully and democratically,” he added.

India’s Prime Minister Narendra Modi wrote on X: “Deeply concerned by the attack on my friend, former President Donald Trump. Strongly condemn the incident. Violence has no place in politics and democracies. Wish him speedy recovery. Our thoughts and prayers are with the family of the deceased, those injured and the American people.”

Also writing on X, Japanese Prime Minister Fumio Kishida stated “We must stand firm against any form of violence that challenges democracy. I pray for former President Trump’s speedy recovery.”

Other world leaders condemning the assassination attempt against the former president included Ukrainian President Volodymyr Zelenskyy, French President Emmanuel Macron and German Chancellor Olaf Scholz. A spokesman from the Chinese foreign ministry noted that “President Xi has expressed sympathies to former President Trump for the shooting incident.”

Harley-Davidson Museum to be site of GOP event in motorcycle mecca Milwaukee

0

Milwaukee, Wisconsin is America’s hog heaven.

The city celebrates its status as the birthplace of Harley-Davidson motorcycles, a high-powered global symbol of American freedom, as the GOP Convention shortly rolls into town.

Delegates to the Republican National Convention say they’re fueled by positive vibes and energy — and some plan to make the Harley-Davidson Museum a key stop during the celebrations and events.

Milwaukee “isn’t necessarily a place where many of our delegates have been before,” Jessica Patterson, chair of the California GOP, said in a release, adding that she wants delegates to get a feel for Milwaukee’s history and culture.

Among other stops, the California delegation’s tour of Milwaukee history will include a luncheon at the Harley-Davidson Museum, according to the release. Fox News Digital reached out to the company and to the museum for additional comment.

The showcase of American motorcycle heritage opened 16 years ago, on July 12, 2008. It’s proven a destination for motorcycle enthusiasts and non-riders interested in American heritage.

The three-building complex on 20 acres contains over 450 Harley-Davidson motorcycles and hundreds of thousands of artifacts from Harley-Davidson’s history, according to the company.

“The Harley-Davidson Museum tells more than the story of a motorcycle brand,” reports travel website wandertooth.com.

“It tells the story of Milwaukee and – it’s really hard to write this in a way that doesn’t sound completely cheesy — of the American Dream.

The museum celebrates the company’s influence on popular cultural and American heritage and also chronicles the dramatic story of the brand, which often teetered on the brink of disaster.

Harley-Davidson was founded in Milwaukee in 1903 by William Harley and partners and brothers Arthur, Walter and William Davidson.

Harley and the Davidson boys grew up neighbors and friends. Harley and Arthur Davidson were both bicycle enthusiasts and mechanics.

They began tinkering with small internal combustion engines. They put motors on bicycles – their first Harley-Davidson motorcycles. Harley-Davidson, the museum notes, sold just three motorcycles in 1905.

Harley-Davidson produced 163,000 bikes in 2023, making it one of the world’s largest motorcycle companies. It brought in more than $5.8 billion in revenue, according to reports from the now publicly traded company.

More dramatically than just the raw numbers, Harley-Davidson motorcycles have grown into a muscular symbol of the United States and the freedom of its open roads.

Harley-Davidson’s image of rugged American individualism makes it a favorite among freedom-loving GOP politicians and supporters.

Here’s what ruthless hackers stole from 130M AT&T customers

0

In a startling revelation, AT&T announced that it had suffered a significant data breach affecting “nearly all” of its cellular customers, as well as customers of mobile virtual network operators (MVNOs) using AT&T’s wireless network and some landline customers.

The data that was taken was from May 1 through Oct. 31, 2022, with a small number of additional records from Jan. 2, 2023, which has raised serious concerns about customer privacy and data security.

Scope of the breach

The compromised data includes records of calls and text messages, along with phone numbers that AT&T or MVNO cellular numbers interacted with during the specified period. For some records, cell site identification numbers were also exposed.

AT&T emphasized that the breach did not include the content of calls or texts, personal information like Social Security numbers or dates of birth, or specific timestamps of communications.

Cybercriminals target cloud platform

AT&T disclosed that the data was illegally downloaded from their workspace on a third-party cloud platform. The company has since taken steps to close off the illegal access point and is working with law enforcement to apprehend those responsible. At least one person has reportedly been arrested in connection with the incident.

AT&T’s customer notification and response

AT&T plans to notify approximately 110 million current and former customers whose information was involved in the breach. The company has created a website to provide more information and resources for affected customers.

We reached out to AT&T, and a company spokesperson provided us with this statement:

“At this time, we do not believe that the data is publicly available. Our top priority, as always, is our customers. We will provide notice to current and former customers whose information was involved along with resources to help protect their information. We sincerely regret this incident occurred and remain committed to protecting the information in our care.”

Delayed disclosure and national security concerns

Interestingly, AT&T, in cooperation with the FBI and the Department of Justice, delayed notifying the public about the breach on two occasions, citing “potential risks to national security and/or public safety.” For its part, AT&T explained that the delayed disclosure was a result of its ongoing collaboration with law enforcement during their investigation into the breach. This decision highlights the complex interplay between corporate responsibility, law enforcement, and national security considerations in cybersecurity incidents.

Recent history of AT&T data breaches

This incident marks the second significant security breach for AT&T in 2024. In March, the company was forced to reset the account passcodes of approximately 7.6 million customers after a cache of customer account information, including encrypted passcodes, was published on a cybercrime forum.

AT&T took this precautionary action after a security researcher warned that the encrypted passcodes could be easily decrypted, potentially compromising customer accounts. This earlier breach affected roughly 70 million past or present customers and reportedly included sensitive information such as Social Security numbers and full names.

Broader implications for data security

This latest incident is part of a larger trend of data breaches targeting cloud platforms. AT&T’s breach has been linked to a series of data thefts from Snowflake, a cloud data giant, which has affected several other companies as well. The breach underscores the ongoing challenges in securing sensitive data stored in cloud environments and the need for robust cybersecurity measures.

As investigations continue and more details emerge, this incident serves as a stark reminder of the persistent threats to data security in our increasingly connected world. It also raises questions about the adequacy of current data protection practices and the need for stronger regulations to safeguard consumer information.

How do I check if my information is on the dark web?

You can go to haveibeenpwned.com to check if your information was sold on the dark web. Just enter your email address into the search bar. The website will search to see your data and display if there were data breaches associated with your email address on various sites. You may have even received an email from the website already saying that some of your data was stolen.

HOW TO REMOVE YOUR PRIVATE DATA FROM THE INTERNET

26 BILLION REASONS TO PROTECT YOURSELF AFTER A MASSIVE DATA LEAK IS EXPOSED

What to do if your information has been stolen

So, what do you do if you were notified or discovered that your info is on the haveibeenpwned.com site? You should take immediate action to minimize the damage. Here are some steps that you can follow:

1. Change your passwords

If hackers have recorded your passwords, they could access your online accounts and steal your data or money. ON ANOTHER DEVICE (i.e., your laptop or desktop), you should change your passwords for all your important accounts, such as email, banking, social media, etc. You want to do this on another device so that the hacker isn’t recording you setting up your new password on your hacked device. And you should also use strong and unique passwords that are hard to guess or crack. You can also use a password manager to generate and store your passwords securely.

2. Enable two-factor authentication

You’ll want to activate two-factor authentication for an extra layer of security.

3. Monitor your accounts and transactions

You should check your online accounts and transactions regularly for any suspicious or unauthorized activity. If you notice anything unusual, immediately report it to the service provider or authorities. You should also review your credit reports and scores to see if there are any signs of identity theft or fraud.

4. Contact your bank and credit card companies

If hackers have obtained your bank or credit card information, they could use it to make purchases or withdrawals without your consent. You should inform your bank and credit card companies of the situation. They can help you freeze or cancel your cards, dispute any fraudulent charges and issue new cards for you.

You should also contact one of the three major credit reporting agencies (Equifax, Experian or TransUnion) and request a fraud alert to be placed on your credit file. This will make it more difficult for identity thieves to open new accounts in your name without verification. You can even freeze your credit, if need be.

5. Use identity theft protection

Identity Theft protection companies can monitor personal information like your home title, Social Security number (SSN), phone number and email address and alert you if it is being used to open an account. They can also assist you in freezing your bank and credit card accounts to prevent further unauthorized use by criminals.

One of the best parts of using an identity theft protection company is that it could include identity theft insurance of up to $1 million to cover losses and legal fees and a white-glove fraud resolution team where a U.S.-based case manager helps you recover any losses. See my tips and best picks on how to protect yourself from identity theft.

6. Alert your contacts

If hackers have accessed your email or social media accounts, they could use them to send spam or phishing messages to your contacts. They could also impersonate you and ask for money or personal information. You should alert your contacts and warn them not to open or respond to any messages from you that seem suspicious or unusual.

7. Invest in personal data removal services

While no service promises to remove all your data from the internet, having a removal service is invaluable, especially after a data breach. These services can help you mitigate the potential damage by ensuring your compromised information is continuously monitored and systematically removed from hundreds of sites. This ongoing process reduces the risk of identity theft, fraud and other malicious activities, providing an additional layer of security and peace of mind. Remove your personal data from the internet with my top picks here.

WHAT TO DO IF YOUR BANK ACCOUNT IS HACKED

Kurt’s key takeaways

The AT&T data breach is another wake-up call for consumers and corporations in our digital age. It underscores the critical need for enhanced cybersecurity measures, particularly in cloud-based systems where vast amounts of sensitive data are stored. As technology evolves, so too must our approach to data protection. This incident should prompt a broader discussion about the balance between technological advancement, user privacy and national security.

It’s also another reminder that we cannot rely on others and need to make ourselves resilient against attacks that are only getting more frequent and destructive. If you do not use tools to enhance your privacy and security, including strong antivirus protection on your iPhone, Android, PC and Mac, use a VPN to insulate your privacy, and actively remove your personal data from the internet, then you are asking for trouble.

In light of this breach, what measures do you think telecom companies should implement to better protect customer data? Should we have been notified of this huge breach earlier than 3 months after the fact?  Let us know by writing us at Cyberguy.com/Contact

As many as 40% of cancer cases — and up to half of cancer-related deaths — could have been prevented.

That’s according to a new study from the American Cancer Society (ACS), which measured the impact of modifiable risk factors for 30 types of cancers among adults over age 30.

Some of those factors were cigarette smoking, alcohol consumption, physical inactivity, excess body weight, dietary choices, ultraviolet (UV) radiation and certain viral infections.

The biggest contributing risk factor was cigarette smoking — which figured into 30% of cancer deaths and nearly 20% of cancer cases.

Excess body weight was the second most impactful, followed by UV radiation and physical activity.

The study findings were published on July 11 in the journal CA: A Cancer Journal for Clinicians.

To reach these conclusions, the researchers analyzed “nationally representative data on cancer incidence and mortality and risk factor prevalence to estimate the proportion and number of cancer cases and deaths attributable to potentially modifiable risk factors overall,” according to an ACS press release.

CANCER NEARLY TOOK HIS LEG, BUT THIS FATHER OF 6 IS WALKING AGAIN: ‘I SHOULDN’T BE HERE’

“A large number of cancer cases and deaths in the United States are attributable to potentially modifiable risk factors, indicating the potential to substantially reduce the cancer burden through prevention,” said lead author Dr. Farhad Islami, senior scientific director, cancer disparity research at the American Cancer Society in Atlanta, in an email to Fox News Digital.

Ernest Hawk, M.D., head of cancer prevention and population sciences at The University of Texas MD Anderson Cancer Center, was not involved in the ACS study but commented on the findings.

“It is great to see these messages re-confirmed and reinforced by the latest data and analyses, but I’m not seeing a lot that is new and novel,” Hawk told Fox News Digital via email.

DOES SUNSCREEN CAUSE SKIN CANCER? DOCTORS DEBUNK CLAIMS GONE WILD ON SOCIAL MEDIA

“Nevertheless, it is important and sobering to see the linkage between modifiable risk factors, cancer incidence and cancer mortality.”

What needs to change?

These findings highlight the need for a greater emphasis on prevention and early detection of cancer, according to Hawk.

“Treatment is always necessary and critically important for those who need it, but we should place a greater priority on personal and societal actions to reduce risks and prevent cancer as our first approach,” he told Fox News Digital.

“A large number of cancer cases and deaths in the United States are attributable to potentially modifiable risk factors.”

“If we do that by taking these issues more seriously, we concomitantly promote health and wellness far more broadly.”

Islami recommended a combination of individual behavioral choices and wider efforts from public, private and community organizations at local, state and national levels.

The new findings highlight the need for a greater emphasis on prevention and early detection of cancer, an expert noted. (iStock)

“This requires multicomponent interventions at multiple levels to increase equitable access to preventive health care and awareness about preventive measures, and widespread implementation of known preventive measures,” he told Fox News Digital.

5 ways to reduce cancer risk

Based on the report findings, here are some of the lifestyle behaviors people should adopt to help reduce their chances of developing cancer, according to experts.

1. Stop smoking

Tobacco exposure is the highest risk factor, responsible for about 55% of cancers in men and 40% of cancers in women.

“The great news is that we have very effective ways to help smokers break their addictions to nicotine,” Hawk told Fox News Digital.

SEVERE HEALTH RISKS OF VAPING AND E-CIGARETTES, ESPECIALLY FOR YOUTH, SAY EXPERTS

The doctor also called for society to “drastically reduce” the opportunity for youth to develop nicotine addictions through ready access to vapes, flavored vapes and nicotine pouches.

“Many such products are technically illegal to sell, yet all too readily available in the marketplace,” he warned.

2. Maintain a healthy body weight

Many people don’t realize there is a correlation between being overweight and getting cancer — “so it is always worth reminding folks of that association,” said Hawk.

“It’s also very exciting that we have a host of new treatments — GLP-1 agonists and associated new compounds that influence other related pathways — that can help patients to achieve and maintain weight reductions,” he continued.

Man with obesity

Excess weight is one of the primary risk factors for cancer, experts agree. (iStock)

“We still don’t know for sure that the new drugs will reduce cancer risks, but emerging animal and human observational data is suggesting that may be the case, which would be most impactful.”

For best results, these therapies can be combined with the longstanding approaches of limiting dietary intake, eating healthy foods and maintaining active lifestyles, according to Hawk.

3. Make healthier food choices

Dr. Marc Siegel, clinical professor of medicine at NYU Langone Medical Center and a Fox News medical contributor, emphasized the importance of a healthy diet in mitigating cancer risk.

“A diet rich in antioxidants, including berries, nuts, fruit, vegetables, olives and unsaturated fats (Mediterranean diet) has been shown to decrease the risk of many cancers,” Dr. Siegel told Fox News Digital.  (iStock)

“On top of that, ultra-processed foods have been shown to increase risks of many cancers, especially gastrointestinal and breast.”

4. Eliminate alcohol intake

“The association between alcohol use and cancer is compelling, but is vastly underappreciated by the public and many health care providers,” Hawk noted.

“Our hope is to see a greater awareness and stronger institutional commitment to actions that align with cancer organizations’ primary mission of reducing cancer cases, cancer deaths, and the cancer risks associated with alcohol.”

5. Get the recommended screenings

Cancer screenings offer additional opportunities for cancer prevention, as well as early detection and treatment — “which often permit treatments to be less toxic, easier to deliver and more effective,” Hawk said.

Woman getting mammogram

Getting regular health screenings is one of the recommended habits for cancer prevention. (iStock)

“New approaches to early cancer detection are on the horizon, such as multi-cancer detection tests that may help us identify more cancers in asymptomatic people, and possibly at a more treatable/curable stage,” he continued.

For more Health articles, visit www.foxnews/health

“This is yet to be proven, but another promising avenue to reducing the burden of cancer in our population.”

These are only a few of the modifiable risk factors. In addition to these five key practices, the experts also recommend exercising regularly, getting the recommended amount of sleep and managing stress levels to help prevent cancer and reduce recurrence.

2,400 Oregon hospital patients potentially exposed to life-threatening viruses

0

Hundreds of patients who visited hospitals in Portland, Oregon, may have been exposed to potentially life-threatening diseases such as hepatitis B and C, as well as HIV, as an anesthesiologist may not have followed the proper procedures while administering anesthetic drugs, health officials say.

Providence and Legacy Health announced in separate statements that more than 2,400 patients in total could be exposed and are in the process of being notified. They encouraged people to get a free blood test from the non-profit hospital systems in order to screen for possible infections.

The Oregon Health Authority (OHA) said that investigations into the breach centered around a physician who delivered intravenous anesthesia — injecting anesthetic drugs into a patient’s vein to put them to sleep — and employed “unacceptable infection control practices, which put patients at risk of infections.” The exact details about how the procedures were not followed have not been revealed.

Hundreds of patients who visited hospitals in Portland, Oregon, may have been exposed to infectious diseases such as hepatitis B and C, as well as HIV, health officials have warned, as an anesthesiologist may not have followed the proper procedures, officials said. (iStock)

Providence, the not-for-profit Catholic health care system, told Fox News Digital in a statement that it is notifying about 2,200 potentially impacted people seen at Providence Willamette Falls Medical Center in Oregon City and two patients seen at Providence Portland Medical Center. The group said that the physician’s actions might have put them at a “low risk of exposure to possible infections” and it will reach out to discuss test results and next steps if a patient tests positive.

“Patient safety is our number one priority, and our patients have our full commitment to a thorough review of this issue and appropriate action,” Providence said in its statement.

The physician, who has not been named, was employed by Oregon Anesthesiology Group (OAG) and worked at the two Providence facilities between 2017 and 2023. The physician is no longer employed by OAG, a third-party contractor, who said that it has implemented new protocols and procedures to prevent future incidents.

The physician also worked at Legacy Mount Hood Medical Center in Gresham for six months starting in December 2023.

Legacy Health, a non-profit hospital system based in Portland, said it was sending letters to 221 patients who may have been affected, Fox 59 reports. Legacy added that it “immediately suspended” the provider after learning of the situation.

“Our community should know that this was an isolated situation involving a single provider, contracted with the Oregon Anesthesiology Group to provide care at Legacy Mount Hood Medical Center for approximately six months beginning in December of 2023,” the group said in the statement.

In a statement, the Oregon Anesthesiology Group said the physician has been terminated.

“When we learned that the physician had violated infection control practices, we suspended him, informed our partners Legacy Health and Providence, and then began an investigation that resulted in the physician’s termination,” the group said in its statement. “Even though the risk of infection was low, new protocols and procedures have been put in place to prevent similar incidents in the future.”

OHA says it is working with Legacy and Providence on their investigations of breaches of infection control practices.

So far, neither OHA nor the hospitals are aware of any reports of illness associated with this infection control breach, the health authority said.

Hepatitis means inflammation of the liver and the condition is often caused by a virus. Hepatitis B and C symptoms include abdominal pain, nausea, vomiting, dark urine or clay-colored stools and fatigue, according to HIV.gov, a site operated by the Department of Health & Human Services.

When severe, acute hepatitis can lead to liver failure, which can lead to death, the WHO says.

HIV infections, meanwhile, often start with flu-like symptoms and can lead to a weakening of the immune system by destroying T-cells until those infected are unable to fight off minor illnesses. HIV can be fatal if left untreated.

WHAT IS ARTIFICIAL INTELLIGENCE (AI)?

The creative process

Building Dave was no small feat. The creator spent weeks designing complex mechanisms, such as the compact system that allows the eyes to move in multiple directions. The mouth mechanism alone took two weeks to perfect, involving more gears than the entire head.

How Dave works

Dave’s lifelike movements are powered by an intricate system of motors and gears. His eyes can move up, down, and side to side, while his eyebrows and mouth corners are also articulated to convey a range of emotions. The eyes, which are probably the most complicated parts of the machine, are connected to each other on a horizontal shaft with vertical axles on both ends. They can be turned up and down with a large motor and side to side using a rack and pinion setup.

Dave’s jaw is a simple hinge with a motor pushing and pulling it, while the corners of the mouth are moved by a lift arm that can be rotated up or down. But Dave isn’t just about hardware. He’s brought to life by nearly 1,100 lines of code that enable him to track hands and faces, recognize faces and objects, read text, count, estimate emotions, age and gender, plus tell time and weather.

Challenges and solutions

One of the biggest challenges was creating Dave’s hair. After struggling with Lego bricks, the creator chose a more practical solution — a wig. This creative workaround required some adjustments to the head’s shape but ultimately proved successful.

Federal judge rules 150-year-old ban on at-home distilling is unconstitutional

A federal judge in Texas has ruled that an 1868 ban on at-home distilling is unconstitutional.

U.S. District Judge Mark Pittman, in his ruling on Wednesday, sided with the Hobby Distillers Association’s lawyers that the 156-year-old ban exceeded Congress’s taxing power and violated the U.S. Constitution’s Commerce Clause. The Hobby Distillers Association is a group that advocates legalizing a person’s production of spirits such as whiskey and bourbon for their personal consumption.

“Indeed, the Constitution is written to prevent societal amnesia of the defined limits it places on this government of and by the people,” Pittman wrote. “That is where the judiciary must declare when its coequal branches overstep their Constitutional authority. Congress has done so here.”

Pittman issued a permanent injunction prohibiting the U.S. government from enforcing the ban against the Hobby Distillers Association’s members. The judge also stayed his decision for 14 days to allow the government to seek a stay at the appellate court level.

People who violate the at-home distilling ban could face up to $10,000 in fines or five years in prison.

Devin Watkins, a lawyer for the Texas-based hobby group at the libertarian think tank Competitive Enterprise Institute, told Reuters that the ruling “respects the rights of our clients to live under a government of limited powers.”

The hobby group, which represented the plaintiffs, and four of its 1,300 members filed a lawsuit in December against the Alcohol and Tobacco Tax and Trade Bureau and the Department of Justice, saying that the government’s regulatory reach could not extend to activities within a person’s home.

The Alcohol and Tobacco Tax and Trade Bureau is a division of the Department of the Treasury that regulates and collects taxes on alcohol, while the Department of Justice can prosecute any felonies.

“This decision is a victory for personal freedoms and for federalism,” Competitive Enterprise Institute lawyer Dan Greenberg said. “We’re pleased to see that the court determined that the home distilling ban is unconstitutional – and that it blocked enforcement of the ban against our clients. More broadly, the court’s decision reminds us that, as Americans, we live under a government of limited powers.”

Pittman said that while three of the individual plaintiffs failed to prove they faced a credible threat of facing prosecution without an injunction, the group and one of its members, Scott McNutt, had carried their burden of showing they would be harmed if the ban was not blocked.

McNutt received an unsolicited letter from the Alcohol and Tobacco Tax and Trade Bureau that said he faced potential civil and criminal liability after it learned he may have purchased materials that could be used to distill spirits.

The Department of Justice claims the ban was a valid measure created by Congress to protect the substantial revenue the government raises from taxing distilled spirits by limiting where plants could be located.

Pittman, however, said the ban was not a valid practice of Congress’ taxing power because it did not raise revenue and “did nothing more than statutorily ferment a crime.”

“While prohibiting the possession of an at-home still meant to distill beverage alcohol might be convenient to protect tax revenue on spirits, it is not a sufficiently clear corollary to the positive power of laying and collecting taxes,” the judge wrote.

The judge said the ban on at-home distilling could also not be covered under Congress’ power to regulate interstate commerce. He said the ban is “not a ‘comprehensive’ scheme of regulation because there are many aspects of the alcohol industry that Congress has left untouched.”

“While the federal government has become more enthusiastic about inflating the scope of its powers over the last century, this case shows that there are limits to the government’s authority,” Watkins, the lawyer for the Texas-based hobby group at the libertarian think tank Competitive Enterprise Institut said in a statement.

“If the government appeals this decision to a higher court, we look forward to illuminating those limits.”
