Dog alerts family, saves Texas teenager from life-threatening stroke: ‘Keeping guard’

0

A teenage boy in Spring, Texas, may owe his life to the family dog, who saved him from a potentially deadly stroke.

Gabriel Silva, 17, was a healthy soccer player with no signs or symptoms of any medical problems when he experienced a dissection of the artery — when the inside wall of an artery gets torn — on Aug 26.

Early that morning, the family’s border collie, Axel, woke up Silva’s mother and stepfather, Amanda and Daines Tanner, by jumping on their bed at around 5 a.m.

TIAS AND MINI-STROKE RISKS: CARDIOLOGIST SHARES WARNING SIGNS AND PREVENTION TIPS

“He was pretty agitated and excited,” Amanda Tanner told Fox News Digital during a phone interview.

“He had both paws on my chest, kind of like he was making sure I was awake and to alert me to whatever was happening downstairs.”

When her husband took the dog downstairs, assuming he had to go outside, Axel led him toward their 17-year-old’s bedroom instead.

That’s where he found their son, who was trying to communicate that something was wrong. Yet his speech was slurred, his vision was impaired, and he couldn’t walk or feel his right side — telltale signs of a stroke.

“When my husband tried to get Gabriel to grip his hand, he couldn’t do it,” she said.

HIGH BLOOD PRESSURE A CONCERN WORLDWIDE, LEADING TO DEATH, STROKE, HEART ATTACK: HOW TO STOP A ‘SILENT KILLER’

The only symptom of a stroke that the teen didn’t have was facial drooping — “but that could have been because it was still early in the stroke and it hadn’t progressed to that level yet,” Tanner said.

Silva’s parents brought him to the closest emergency room, where doctors immediately began treating him with blood thinners. Following that came a battery of tests and scans.

Silva was then transferred to Memorial Hermann-Texas Medical Center, where an angiogram revealed that the teen had experienced a dissection of the artery.

“That normally happens through trauma, like a car accident, but in Gabriel’s case it was spontaneous,” Tanner told Fox News Digital.

“There was no explanation. It just happened.”

“There was no clot, no cholesterol issue. They did a thorough battery of tests to find the root cause, and there was no explanation. It just happened.”

Following the diagnosis, Silva’s artery had to be given a chance to reconnect. The blood thinners helped to reduce the potential of further damage, Tanner said — “but the damage that was done is done.”

The stroke had mainly affected the communication center in Silva’s brain, which impacted speech. He also was unable to walk at first, due to losing control of his right side.

Once the doctors determined that Silva wasn’t at risk of a continued or recurring stroke, the teen began therapy sessions to try and regain as much functionality as quickly as possible.

“I would cry when the nurses would come in and ask him to say his name, and he couldn’t do it.”

“He had to relearn the alphabet,” Tanner said. “I would cry when the nurses would come in and ask him to say his name, and he couldn’t do it.”

The road to recovery

Today, Silva is showing significant improvement. He was able to walk again within a week of the stroke, and he was just released from physical therapy on Thursday.

The teen is also in occupational therapy and speech therapy. The speech has been a bigger challenge, but he is making progress, Tanner said.

Throughout the entire process, Silva has been determined to return to his regular activities and have a normal senior year.

“He’s ready to go back to school,” Tanner said. “He wants to play soccer again.”

The teen is currently raising money to go on a mission trip to the U.K. with his church next summer.

The stroke has “amplified the way that he thinks about life,” she said. “He looks at everything differently. He sees no reason to dwell on things.”

HELP DESPERATELY NEEDED: AMERICAN HEART ASSOCIATION LAUNCHES ‘NATION OF LIFESAVERS’ PROGRAM

Silva’s goal has long been to attend Texas A&M University and become a civil engineer.

“At first it was hard, because he felt like after everything he planned for, his life was over — but I told him it’s just going to look different,” Tanner said.

The family has received an outpouring of support from their church group, school and community, with different groups of people visiting the hospital each day.

That included the high-school soccer coach, who brought a ball signed by the entire team — a moment that brought Silva to tears.

“God and our church friends have been our whole support system,” Tanner said. “Without them, I don’t know what we would have done.”

Rescued by a rescue

Tanner said she wishes she could thank Axel, their border collie, for saving her son’s life.

Given that it was a Saturday morning, had the dog not alerted them, she said she likely wouldn’t have even thought to enter her son’s bedroom until noon.

“It could have been a good five or six hours before we would have been alerted to him being passed out at that point,” she said. “The doctors explained how much of a difference it made with being able to get Gabriel to the hospital that much sooner.”

Since Silva’s stroke, Tanner said Axel has been actively trying to comfort each member of the family.

The family rescued the dog when he was just 2 weeks old — he was one of nine puppies whose mother had died.

“He only knows human touch, so he communicates in human ways,” Tanner said. “He puts his head on our shoulders and gives us hugs, like he’s trying to help all of us.”

The American Stroke Association outlines the F.A.S.T. warning signs of a stroke on its website:

  • F = Face Drooping – Does one side of the face droop or is it numb? Ask the person to smile. Is the person’s smile uneven?
  • A = Arm Weakness – Is one arm weak or numb? Ask the person to raise both arms. Does one arm drift downward?
  • S = Speech Difficulty – Is speech slurred?
  • T = Time to call 911 – Stroke is an emergency. Every minute counts. Call 911 immediately. Note the time when any symptoms first appear.

Every 40 seconds, someone in the U.S. has a stroke, according to the Centers for Disease Control and Prevention (CDC).

Although stroke risk increases later in life, it’s possible to experience one at any age.

Fewer than 40% of those hospitalized due to a stroke are younger than 65, per the CDC.

Students sat at midfield linking arms in protest before the start of Saturday’s University of California, Berkeley game against USC.

Fifteen people protested, police confirmed, delaying the game several minutes.

Fourteen adults were transported to Alameda County Jail for booking, while one juvenile was sent to UCPD for processing, police said.

Rumors circulated online that the protest was in support of Palestinians in their conflict with Israel, but the protestors were supporting UC Berkeley professor Ivonne del Valle, who was suspended for alleged stalking.

Some were wearing shirts that said “Justice for Ivonne.”

KQED reported three investigations found del Valle repeatedly harassed and stalked Joshua Clover, a professor at UC Davis, for roughly four years and even violated orders not to get in touch with him. Del Valle was also suspended for nine months in 2021. The outlet says the protest had been planned out.

“We want Ivonne back,” said Christián González Reyes, a student who KQED says “organized the campaign.”

“We’re not going to be silent anymore.”

“We were aware a protest may take place at today’s game, and our top priority was the safety and well-being of our student-athletes, coaches and fans,” the California athletic department told Fox News Digital. “We are grateful for the work our security personnel did today to ensure we had a peaceful resolution.”

Del Valle admitted to visiting Clover’s mother’s home, calling his office line at least 10 times within a 90-minute span and attaching a note outside his door that said, “Here lives a pervert.” The investigation also found she once keyed his car, contacted his friends and posted a photo of his partner online.

“If I had the opportunity to do things differently, I would do them differently,” del Valle told the outlet, adding she was “not proud.”

Del Valle agreed not contact Clover, his family, or friends in 2020, but she allegedly violated that order the following year, resulting in the nine-month suspension.

US court issues mandate for Grayscale ruling, paving way for SEC to review spot Bitcoin ETF

The United States Court of Appeals has issued a mandate following a decision requiring Grayscale Investments’ application for a spot Bitcoin exchange-traded fund (ETF) to be reviewed by the Securities and Exchange Commission (SEC). In an Oct. 23 filing, the “formal mandate” of the court took effect, paving the way for the SEC to review its decision on Grayscale’s spot Bitcoin ETF. Coinbase disputes SEC’s crypto authority in final bid to toss regulator’s suit

The U.S. Securities and Exchange Commission overstepped its authority when it classified Coinbase-listed cryptocurrencies as securities, the exchange has argued in its final bid to dismiss a lawsuit by the securities regulator. In an Oct. 24 filing in a New York District Court, Coinbase chastised the SEC, claiming its definition for what qualifies as a security was too wide, and contested that the cryptocurrencies the exchange lists are not under the regulator’s purview. The SEC sued Coinbase on June 6, claiming the exchange violated U.S. securities laws by listing several tokens it considers securities and not registering with the regulator.

Kansas pulls off upset over No. 6 Oklahoma with late heroics

0

The chalk is rocking in Kansas.

The unranked Jayhawks upset their Big 12 rivals in No. 6 Oklahoma with an incredible 38-33 victory in Lawrence.

Oklahoma made it a 27-26 game, just as the third quarter ended, but Kansas marched right down the field, thanks to three Oklahoma personal fouls, including a targeting penalty at the one-yard line that gave the Jayhawks a 1st and goal. Daniel Hishaw Jr. found the end zone, but Kansas, too, missed the two-point conversion, so with 12:25 to go, it was 32-27 in favor of Kansas.

But Oklahoma didn’t even have a chance to answer as they fumbled the ensuing kickoff, and Kansas recovered it at the opposite 20. However, they missed the field goal, giving the Sooners a chance.

Oklahoma punted, but on third down, Jason Bean threw a pick deep in Kansas’ own territory, and Oklahoma four plays later. The two-point conversion again failed, so it was 33-32 Sooners with 5:22 left.

On 3rd and 3 in their own territory inside of three minutes to go, Bean threw a dump pass that was picked off at the line of scrimmage. The Jayhawks defense forced a punt, though, and after a touchback, they had 2:05 to make magic happen.

Bean got the Jayhawks to midfield after two plays, and on a 4th and 6, he found Lawrence Arnold for a 37-yard gain to put Kansas inside the 10. The Sooners defense allowed Evan Neal to score a nine-yard touchdown, as Kansas had no timeouts. Stop us if you’ve heard this: The two-point conversion failed, so Kansas led 38-33 with 55 seconds left.

Gabriel found Brenen Thompson for a long gain to put Oklahoma in scoring range, but the last play fell incomplete, giving the Jayhawks the win.

Neal, Bean and Hishaw combined for four rushing touchdowns, with Hishaw owning a pair, while the first scoring play of the game was a pick six by Mello Dotson. The Jayhawks ran for 225 yards on the day.

Tawee Walker rushed for 146 yards and a touchdown on his 23 carries in the losing effort. Gabriel rushed for three scores.

It’s the Sooners’ first loss of the season, putting cold water on their College Football Playoff hopes.

Productivity collides with privacy

Factors such as employee morale and the potential for power abuse warrant careful attention from both employers and employees. So, finding a middle ground that ensures security and productivity while preserving individual privacy and trust is crucial.

Employment contracts and policies

Company handbooks often explicitly state that employees should not expect privacy when utilizing company resources. Agreeing to such terms provides a clear legal framework for workplace monitoring.

Shockingly secret ways your boss can monitor you

In today’s digitized work environment, understanding the various ways your boss can monitor you is essential. Let’s delve into the wide range of software and methods that companies utilize to keep tabs on your workflow and activities.

Invasive employee-monitoring software

You should be aware that some software invades your privacy as an employee by capturing screenshots, logging keystrokes, and taking webcam pictures without your consent.

Let’s start with Teramind, which tracks everything you do on your computer, from your screen to your email. It can also record your keystrokes and your Zoom sessions. Your employer can watch what you are doing in real-time or review the recordings later.

Next there’s Veriato Cerebral software that uses artificial intelligence to analyze your activity and measure your engagement. It takes video snapshots of your screen and pairs them with your keystrokes. It also monitors how productive you are and how much time you spend on distracting activities.

The third software to tell you about is Hubstaff, which tracks how much time you spend on your tasks and records your activity levels. It also logs your mouse movements, keystrokes, URLs and apps. It can also track your location through geolocation features if you use a mobile device.

Then there’s StaffCop Enterprise. This software provides a comprehensive framework for surveillance, data collection and reporting. It can record audio and video from your computer, control your remote desktop, capture images from your webcam and extract text from screenshots and documents.

Moving on to Spyzie, which, as the name indicates, spies on you with software that tracks your activity and location through your smartphone. Your employer can see where you are and where you go during your work hours, including any stops or detours you make along the way.

Finally, there’s CleverControl. The key word here is “control.” This software not only monitors how long you are active on your keyboard but also allows your employer to secretly activate your camera and microphone to record your surroundings. It can also log your keystrokes and capture images of your screen.

Extreme cases of spying on employees

Imagine that you are working hard at your job, but your boss does not trust you. He or she wants to know everything you do, even when you are not at work. Here are some real-life examples of extreme cases of spying on employees:

● A boss secretly puts a GPS device on their employee’s personal car and tracks where they go. This is very creepy and violates their right to privacy. They should be able to go wherever they want without being watched by their boss. According to the Electronic Frontier Foundation, this is illegal in most states in the U.S.

● A boss snoops on their employee’s personal email and social media accounts. This absolutely invades their privacy. They may have personal and sensitive information that they do not want to share with anyone, especially not their boss. According to the American Civil Liberties Union (ACLU), your boss needs a good reason and your permission to access your personal communications.

● A boss records their worker’s activities or conversations through hidden cameras or microphones without telling them. This is very sneaky and violates their privacy. They may have private and confidential information that they do not want anyone to hear or see. According to Workplace Fairness, your boss needs to follow federal and state laws that regulate video and audio surveillance in the workplace.

● A boss follows or observes an employee without them knowing. This is very scary and can make them feel unsafe. They should be able to work without being followed or watched by their boss. According to the National Conference of State Legislatures, most states have laws that protect you from unwanted and repeated surveillance by another person.

These are just some extreme cases of spying on employees that can make them feel violated, angry and distrustful.

There are some ways to detect whether your employer is using spying software to monitor you, depending on the type and level of monitoring they are doing.  (Cyberguy.com)

How to detect workplace spying and monitoring

There are some ways to detect whether your employer is using spying software to monitor you, depending on the type and level of monitoring they are doing. Here are some common methods you can try:

Check your Task Manager and Activity Monitor: Look for unfamiliar active processes. This is a good place to start, as most spyware tools will need to run in the background to monitor your activities. You can access the Task Manager on Windows by pressing Ctrl+Alt+Delete and selecting Task Manager. You can access the Activity Monitor on Mac by pressing Command+Space and typing Activity Monitor. You will see a list of processes that are running on your computer. Look for any process that you don’t recognize or that has a high CPU or memory usage. You can right-click on any process and select Search online to get more information about it on Windows, or double-click on any process and select Open Files and Ports to see what files and network connections it is using on Mac.

Check for unknown installed software: Some spyware tools may install themselves as applications on your computer, which you can find in the list of installed programs or applications. You can access this list on Windows by going to Start Menu > Settings > Apps. You can access it on a Mac by going to Finder > Applications. Look for any app that you don’t remember installing or that has a suspicious name or publisher.

Check the system tray icons: Some spyware tools may show themselves as icons in the system tray, which is the area at the bottom right corner of your screen on Windows, or the top right corner of your screen on Mac. Hover over or click on any icon to see its name and status. Look for any icon that you don’t recognize or that looks suspicious. You can right-click on any icon and select Exit or Disable to stop it from running on Windows, or hold down the Command key and drag any icon out of the menu bar to stop it from running on Mac.

Check for VPNs and proxies: Some spyware tools may use VPNs (virtual private networks) or proxies to hide their network activity or location, which can be a sign of network monitoring. You can check whether your computer is connected to a VPN or proxy by going to Start Menu > Settings > Network & Internet > VPN on Windows, or Apple Menu > System Preferences > Network > VPN on Mac. You will see a list of VPN connections that are configured on your computer. Look for any VPN connection that you don’t recognize or that is active without your knowledge.

To check for proxies, go to Start Menu > Settings > Network & Internet > Proxy on Windows, or Apple Menu > System Preferences > Network > Advanced > Proxies on Mac. You will see a list of proxy settings that are configured on your computer. Look for any proxy setting that is enabled without your knowledge or that has a suspicious address or port.

Check the browser extensions: Some spyware tools may use browser extensions to monitor your web browsing activity, which can be done by accessing your browser history, cookies, passwords or other data. You can check whether your browser has any suspicious extensions by going to Menu > More Tools > Extensions on Chrome, Menu > Add-ons > Extensions on Firefox, or Safari > Preferences > Extensions on Safari. You will see a list of extensions that are installed on your browser. Look for any extension that you don’t recognize or that has a suspicious name or developer.

MORE: BEST VPNS FOR BROWSING THE WEB

These are some of the ways to detect whether your employer is using spying software to monitor you, but they are not foolproof or exhaustive. Some spyware tools may be able to evade detection by using stealth techniques or encryption.

If you suspect that you are being monitored, you should be careful about what you do on your work computer and consult with an IT expert or a lawyer if possible.

Best practices

Know the policies and laws: Research your company’s policies and local laws. Understand what’s allowed and what isn’t.

Use personal devices: Keep personal and work activities separate.

Secure your communications: Be mindful of who might be monitoring.

Speak up: Open dialogue may be possible in some workplaces.

Legal and career implications

Unauthorized access: Illegal in many jurisdictions.

Breach of contract: Could be a breach of your employment contract.

Intellectual property: Tampering is illegal.

Data tampering: Another potentially illegal action.

Alternative courses of action

If you ever need to store a personal appointment in your company calendar, you should categorize it as private so it will be visible only to you. If you have a choice between using a personal or corporate VPN, one better option would be to use the personal VPN.

The best way to avoid issues is to use personal equipment. If you need to use personal accounts, bring an iPad or use your phone, but avoid personal data on company equipment, as that data would also be backed up on company servers. Discuss concerns openly with your employer. Lastly, consult a legal professional for advice focused on your specific situation if monitoring seems excessive.

Workplace monitoring varies greatly, depending on the employer and the state. Being aware of the types of monitoring and your rights can help you navigate this evolving workplace issue.

Kurt’s key takeaways

Workplace monitoring is not just a matter of legality but also one of ethical responsibility and transparency. Employers have various tools at their disposal to track employee performance and behavior, ranging from time-tracking software to more invasive measures like keystroke logging and video surveillance.

However, it’s crucial for both parties to understand the balance between maintaining productivity and ensuring employee morale. Open communication, clearly stated policies and a comprehensive understanding of applicable laws can help create a work environment that respects both corporate interests and individual privacy.

World Series Game 2: Diamondbacks look to rebound after Rangers walk-off victory

0

The 2023 World Series continues tonight in Arlington, Texas.

Late innings heroics turned Game 1 of the series between the Arizona Diamondbacks and the Texas Rangers into an instant classic. Four-time All-Star Corey Seager crushed a game-tying home run off D-backs closer Paul Sewald in the ninth to send the game into extra innings.

Adolis García stepped up to the plate in the 11th inning and hit a ball just over the right-field wall to cap the Rangers 6-5 comeback victory. Texas now needs just three more wins to secure the first World Series title in franchise history.

PITCHING MATCHUPS

Right-hander Merrill Kelly is set to take the mound for the D-backs. The 35-year-old pitcher is 2-1 this postseason with a 2.65 ERA over three starts. He gave up three home runs in the second game of the NLCS against the Philadelphia Phillies.

Kelly has likely become accustomed to handling playoff road atmospheres, as all three of his 2023 postseason starts have come on the road. He delivered perhaps his strongest pitching performance when he struck out eight batters over five innings in a pivotal Game 6 of the NLCS in front of a raucous crowd at Citizens Bank Park.

Meanwhile, left-hander Jordan Montgomery has been named the starter for the Rangers. Texas acquired Montgomery in a trade during the regular season. He posted a 2.79 ERA over his 11 starts in the regular season with the Rangers. He has gotten the ball first every time Texas has had a Game 1 or 2 on its postseason schedule this year.

Montgomery came on in relief during the Rangers series clincher over the 2022 World Series champion Houston Astros.

The world’s first certified passenger-carrying air taxi takes flight

0

Imagine flying over the city in a pilotless, electric-powered aircraft that can take you from point A to point B in minutes without a pilot onboard. Sounds like science fiction, right? Well, not anymore.

China-based Ehang has become the world’s first company to receive airworthiness certification for its fully autonomous, passenger-carrying air taxis.

What are electric air taxis?

Ehang’s EH216-S air taxis are electric vertical take-off and landing (eVTOL) aircraft that can carry up to two passengers or 600 pounds of cargo. They are powered by 16 electric rotors and can fly at speeds of up to 80 mph and distances of up to 18 miles.

How do electric air taxis operate without pilots?

The air taxis are controlled by a centralized command and control center that monitors the flight status, routes and weather conditions.

Passengers can simply select their destination on a touchscreen inside the cabin and enjoy the ride without worrying about piloting the aircraft

The air taxis do not require traditional infrastructure such as airports or runways. They can take off and land vertically from any flat surface, such as a rooftop, parking lot, or park.

The air taxis use electric power to reduce environmental harm caused by emissions. They can be fully charged in two hours and have low noise levels.

The EH216-S vehicles have multiple redundancies in their systems, such as backup batteries, rotors, and communication links.

They also have emergency landing systems and parachutes in case of any malfunction.

How did these China-based electric air taxis get the approval to fly?

Since 2014, over 40,000 test flights have been conducted in various locations around the world. In January 2021, Ehang applied for a type certificate from the Civil Aviation Administration of China (CAAC), which is the official recognition of the airworthiness of an aircraft.

The CAAC evaluated Ehang’s air taxis for over 500 parameters, such as structural strength, software simulation, flight performance and electromagnetic compatibility. The process took more than 1,000 days and involved extensive laboratory, ground and flight tests.

On October 15, 2023, Ehang announced that it had received certification from the CAAC, making it the first company in the world to obtain such a certification for passenger-carrying eVTOL aircraft. This means that Ehang can now start commercial operations of its air taxis in China. As Ehang’s founder-chair and CEO Huazhi Hu said, “Embracing the certification as our springboard, we will launch commercial operations of the EH216-S air taxis, prioritizing safety above all.”

What are the potential applications of electric air taxis?

Ehang’s air taxis have a wide range of potential applications for urban air mobility (UAM), which uses aerial vehicles to provide transportation services in urban areas.

They can help you avoid traffic jams and save time on your commute. They can also take you to places that are hard to reach by car or public transportation. Whether you need to go to a business meeting, a tourist attraction or a hospital, Ehang’s air taxis can get you there quickly and conveniently. Ehang’s air taxis can also offer you a new perspective of the city with views of the skyline, landmarks and nature, all from above.

Beyond just transporting people, these aircraft can be used for delivering goods, such as packages, medical supplies or food. They can also be used for emergency situations, such as natural disasters or accidents. In those situations where time is of the essence, these vehicles could transport much-needed medical personnel or equipment to the scene quickly and safely.

What are the challenges for pilotless air taxis?

Ehang’s air taxis are a groundbreaking innovation that could revolutionize the future of transportation. However, they also face some challenges in terms of regulation, technology, market demand and social acceptance.

China-based Ehang has become the world’s first company to receive airworthiness certification for its fully autonomous, passenger-carrying air taxis.  (Ehang)

Ehang’s air taxis need to comply with the laws and regulations of different countries and regions where they might operate. They also need to coordinate with other aircraft that use the same airspace. Ehang has been working closely with regulators to establish standards and policies for UAM.

One big hurdle is working to gain social acceptance and trust from the public. The manufacturer needs to educate and inform us about the benefits and risks of UAM. It also needs to address the potential issues and concerns of noise, privacy and environmental impact. For its part, Ehang has been conducting public demonstrations and campaigns to raise awareness and confidence in UAM.

Kurt’s key takeaways

Ehang’s air taxis are a pioneering achievement that could transform how we travel in cities across this country. By receiving the first industry approval for fully autonomous, passenger-carrying air taxis, Ehang has opened up new possibilities and opportunities for UAM. But with all new technology comes challenges, and those are what Ehang needs to tackle to be successful moving forward.

Sam Bankman-Fried’s perspective on FTX fall

0

Sam “SBF” Bankman-Fried took the stand this week to testify in his ongoing criminal trial in the Southern District of New York, denying any wrongdoing between FTX and Alameda Research, while acknowledging making “big mistakes” during the companies’ fast-paced growth.

His official testimony started on Oct. 27, after a hearing on the previous day without the jurors present. During the hearing, Bankman-Fried struggled to answer questions raised by government attorneys, whereas he appeared much better prepared the following day to face the jury.

A few highlights of Bankman-Fried’s testimony this week include denying directing his inner circle to make millionaire political donations in 2021, as well as claims that FTX’s Term of Uses covered transactions between Alameda and the crypto exchange. Moreover, the former CEO stated that he had requested additional hedging strategies for Alameda throughout 2021 and 2022, but they were never implemented.

The defense is expected to conclude Bankman-Fried’s examination on Oct. 30, followed by the prosecution’s cross-examinations and closing arguments from both sides. Prosecutors also hinted about a possible rebuttal witness next week — someone who is called to prove that the testimony of another witness is false or inaccurate.

Bankman-Fried could be jailed for 115 years if found guilty of all fraud and conspiracy counts. Cointelegraph’s on-the-ground coverage of his testimony is summarized below.

SBF refutes claims over political donations

Bankman-Fried denied in court having directing Ryan Salame, former co-CEO of FTX Digital Markets, and Nishad Singh, former director of engineering, to funnel millions of dollars in contributions to political campaigns.

According to data available on OpenSecret, Singh gave $8 million to federal campaigns in the 2022 election cycle. Salame also donated $10 million to politicians via loans from Alameda Research.

Even though Bankman-Fried denied instructing both to make political contributions, he recognized that lobbying in Washington, D.C. played a key role in his efforts to push a regulatory framework for crypto firms in the United States during 2021.

“I came to believe that I could impact the world.”

According to prosecutors, Bankman-Fried used funds from customers’ deposits on FTX to make more than $100 million in political campaign contributions ahead of the 2022 midterm elections.

Bankman-Fried denied any wrongdoing during his testimony, asserting that FTX had more than $1 billion in revenue in 2021 and that political donations were made from the exchange’s own funds.

The New York Times test

Bankman-Fried had a guideline for employees’ communication at FTX and Alameda Research: The New York Times test.

Based on the informal test, employees should not write anything they wouldn’t be comfortable seeing on the front page of the newspaper. According to Bankman-Fried, even harmless things could “look pretty bad out of context,” so employees should be sure to always provide sufficient context in written messages.

Bankman-Fried described the test as part of his explanation of why more than 200 channels on Signal had an autodelete policy that permanently deleted messages after a week.

Prosecutors used evidence of the autodelete feature in the previous days to suggest that any wrongdoing between the companies was being covered up. According to Bankman-Fried, official communications and regulatory paperwork were handled through other channels, such as Slack or email, but Signal was the choice for daily communication within the companies.

Alameda’s unique role on FTX

Bankman-Fried provided details about Alameda’s billionaire line of credit with FTX. According to his testimony, Alameda served as FTX’s payment provider for wire transactions while the exchange was unable to have its own account.

Besides being a payment processor, Alameda was also the primary liquidity provider, market maker and a client of FTX.

As liquidity provider and market maker, Alameda would have to step in and cover customer losses if FTX’s risk engine failed. During his testimony, Bankman-Fried provided an example of a failure of the risk engine that resulted in Alameda covering millions of dollars in losses in 2021.

The nature of Alameda’s role in the exchange’s operations prompted custom features in FTX’s code, such as the ability to go negative via a line of credit without activating the risk engine. According to Bankman-Fried, the exemption was necessary to prevent Alameda’s potential liquidation, which would negatively impact the crypto markets.

As a client of FTX, Alameda was also able to borrow funds by depositing collateral in the exchange. The terms of use of FTX allow borrowers to use funds for any purpose, which means Alameda could trade with the borrowed funds.

Alameda’s line of credit with FTX grew along with the crypto industry during the bull market.

Alameda fails to hedge

Bankman-Fried discussed hedging strategies with Caroline Ellison, former CEO of Alameda Research, in 2021 and 2022 while seeking to shield the trading platform from a possible market downturn.

According to his testimony, Bankman-Fried asked Ellison to hedge $2 billion in Bitcoin (BTC) against a possible price decline in 2021. The strategy was never implemented, he told jurors.

Notes of Ellison shared as evidence by prosecutors reveal that Bankman-Fried was “freaking out” about hedging in early 2022. The defense used the evidence to illustrate that hedging was one of Bankman-Fried’s highest concerns and discussed with Ellison frequently.

Without appropriate hedging in place, Alameda was significantly harmed by the Terra ecosystem collapse and decline in crypto prices. In September 2022, Bankman-Fried learned the liability between the companies had grown from $2 billion a year before to over $8 billion.

“I was very surprised,” he claimed in court, stating that he believed Alameda’s assets outweighed its liabilities by nearly $10 billion.

Clawback provision in Terms of Use

According to Bankman-Fried, FTX’s terms of use include a clawback provision that would socialize losses among customers using margin trade and futures contracts in the event that the exchange’s risk engine fails.

The document presented in court states that:

“[…] your account balance may be subject to clawback due to losses suffered by other users.”

If FTX could not cover losses related to spot margins and futures, damages would be shared among all customers. Defense lawyers used the provision to argue that customers trading on FTX were aware of the risks involved.
